सुप्रीम कोर्ट ने Supertech को दिया 4 हफ्तों का समय, करना होगा ग्रहाको का पैसा वापस

नई दिल्लीः सुप्रीम कोर्ट ने सुपरटेक बिल्डर्स को निर्देश दिया है कि वह नोएडा के एमरल्ड कोर्ट के फ्लैट धारकों को चार हफ्ते में पैसे लौटाए। मामले की सुनवाई 9 अगस्त को होगी। सुपरटेक ने सुप्रीम कोर्ट रजिस्ट्री में पांच करोड़ रुपए जमा किए हैं। सुनवाई के दौरान सुपरटेक ने कहा कि उन्होंने सुप्रीम कोर्ट के आदेश के मुताबिक पांच करोड़ रुपए सुप्रीम कोर्ट की रजिस्ट्री में जमा कर दिए हैं।

मामले की अंतिम सुनवाई 9 अगस्त को
सुप्रीम कोर्ट ने रजिस्ट्री को निर्देश दिया कि वे इन पैसों को फिक्सड डिपॉजिट स्कीम में जमा कर दें। फ्लैट खरीददार बिल्डर से संपर्क कर पैसै लौटाने की अर्जी एडवोकेट ऑन रिकॉर्ड को दे सकते हैं। उन अर्जियों को देने के चार हफ्ते के भीतर बिल्डर को फ्लैट धारकों को पैसे लौटाने होंगे। सुप्रीम कोर्ट ने इस मामले पर अंतिम सुनवाई 9 अगस्त को करने का फैसला किया है। इसके पहले छह जनवरी को सुप्रीम कोर्ट ने सुपरटेक बिल्डर्स की इस अर्जी को स्वीकार कर लिया था कि उसे दस जनवरी तक दस करोड़ रुपए जमा करने से छूट दी जाए…….आगे पढ़ें

Screenshot - 3_16_2017 , 11_34_12 AMNew Delhi: As the law is getting strict for Builder Consumer disputes the judiciary bodies are also functioning on their full pace and an another case of serving justice to the consumer has been noticed as on Tuesday the Apex consumer commission has ordered Supertech Builder to pay a amount of Rs. 55 Lakh to a Home buyer for failure in giving possession on time.

In this land mark judgment the court also ordered the builder to pay Rs. 10000 as the litigation cost to the resident of south Delhi Mr. Ranjeet Bhatia

Bhatia filed a complaint against the builder in which he said that, he had booked a flat in Supertech’s Noida project for Rs. 1.35 Crore and according to the agreement the allotment of the flat should be given in 2015 but the firm failed to do so hence Bhatia filed a case against the firm for refund

Justice V.K Jain said that Considering the failure of the OP (Opposite Party) to perform its contractual obligation by offering possession of the flat booked by the complainant, the complainant cannot be compelled to wait for an uncertain period till the OP is able to complete construction of the flat which it had booked by them,”

amrapali.jpgनई दिल्ली: भारत की राजधानी दिल्ली से सटे इलाके ग्रेटर नॉएडा मे कई रिहाइशी प्रोजेक्ट्स के नाम पर धोका धडी करने वाली कंपनी Amrapali का कर्ताधर्ता अनिल शर्मा इन् दिनो media से नजरे चुरा रहा है |

लोगो में बढ़ता गुस्सा इस बात का सबूत है की Amrapali लोगो से किये गए वादे पूरे करने में असमर्थ है और कई हज़ार करोड़ के घोटाले को अंजाम दे चूका है | लगभग 17 से भी ज्यादा Amrapali की आवासीय योजनाएं तकरीबन 7 साल से भी ज्यादा समय से पूर्ण रूप से बंद पड़ी है और दिन-ब-दिन लोग अपना घर पाने की उम्मीद खोते जा रहे है |

प्रशासन द्वारा की जा रही इस अनदेखी को सरकार पर पूंजीपतियों  का दबाव समझा जाये या फिर उनकी लापरवाही क्योकि अनिल शर्मा पर अब तक की गई कार्यवाहियों का कोई असर दिख नहीं रहा है और जनता इस बात से भी अनजान है की अनिल शर्मा इस समय भारत में है या फिर विजय माल्या और ललित मोदी की तरह देश से फरार हो चूका है |

रियल्टी मीडिया की Amrapali ग्रुप के खिलाफ की गई इस पहल और बुलंद आवाज़ से आज कल चुनावी माहोल में नेताओं को नया मुदा मिल गया है सपा के मंत्री रविदास मेहरोत्रा अपने एक बयान में अनिल शर्मा क देश से फरार होने का कयास लगा चुके है | पर कई हज़ार करोड़ का ये घोटाला सिर्फ एक चुनावी मुदा बनकर ना रह जाये इसके लिए रियल्टी मीडिया अपनी मुहीम पर अटल रहेगा |

अब देखना यह है की क्या सरकार अनिल शर्मा और Amrapali ग्रुप पर जल्द कोई ठोस करवाई करेगी या फिर इससे भी फरार होने का पूरा वक़्त दिया जायेगा।

Few days’ back it was Supetech fined by the court of Rs. 41 lakh and Now its DLF who has been fined with Rs. 55000 by the consumer form (Chennai) for not fulfilling its promises to customer. S Jayanthi and sreedhar booked a flat in DLF’s Garden City Complex in 2008 and the price of that apartment was Rs. 40 Lakh. In the buyers agreement it was promised that DLF will give a discount Rs. 200 per sq. ft. as timely payment rebate. The builder didn’t give the possession on time nor did it provide the promised rebate. Soon after sreedhar issued a legal notice DLF asked him to pay more because of increase in taxes like VAT and service charges. Sreedhar moved to district consumer disputes redressal forum, north Chennai. Where the court said that: “DLF had said Sreedhar had paid all installments within time except for a four-day delay in payment of around Rs 4.05 lakh. But DLFs argument was wrong as the date of encashment of the cheque could not be held as delay in payment. Sreedhar had paid around Rs 92,000 extra as the builder did not provide him the agreed rebate” Because of the delay of 14 months in providing the apartment, the builder had to pay compensation along with case costs, the bench said. DLF had also to register the Undivided Share of Land in his favor.

entitled-shipping-refund-what-knowAruna Nanda who had purchased a flat in Supertech’s project Eco Village at Greater Noida extension in 2010 took a remarkable step and forced the Builder to payback her money.

Supertech Limited has been asked to payback Rs. 40.98 lakh within three months by the Delhi State Consumer Redressal Commission to a homebuyer for delaying in giving possession of the flat in Greater Noida.

The court quoted that “There is frequent change in the flat booked by complainant, area and cost of the flat. That too without the consent of the complainant. Supertech has no right to unilaterally change the number of the flat, size and price. While decreasing area, the builder enhanced the price…

“After considering the rival submission I feel that complainant cannot be forced to accept possession after about seven years. There is no fault on the part of complainant. If Supertech had not been able to complete its project within time stipulated, it has to suffer and none else,” the bench presided by Member O P Gupta said.

The builder said “ due to slumps in market we are not in position to refund the amount and we have already invested a lot of amount in this project.

SuperTech builder is facing a hard time now, as on Monday Greater Noida Industrial Development Authority (GNIDA) started sealing 382 flats and villas of SuperTech’s Czar Suites as per the orders passed on January 11th by Allahabad high court to not to issue completion certificate to the project and take strict action against the builder as the constructed building is against and violating the sanctioned building plan.

Following the orders of Court GNIDA on Monday took action and started sealing various flats and villas. The officials said, “Teams from the architecture and planning department collected physical details of the number of units the builder has built as part of the project and those sanctioned as per layout plans approved by GNIDA

R K Arora, CMD, Supertech group, said the company had not violated any building norm and denied the units were being sealed by GNIDA.
